Articles of Gold ("AOG,” “we,” “us,” or “our”) provides an online store, content, and related services (collectively, the “Services”) through our website at https://www.articlesofgold.com (the “Site”). By accessing or using the Services, you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Services.

1) Eligibility

You must be at least the age of majority in your jurisdiction and capable of entering a binding contract. You represent that any information you provide to us is accurate and complete.

2) Accounts & Security

You may browse the Site without an account. Certain features (e.g., wishlists, orders, Private Client access) may require an account. You are responsible for maintaining the confidentiality of your login and for all activity under your account. Notify us immediately of any unauthorized use.

3) Orders, Acceptance & Availability

Placing products in a cart or wishlist does not reserve inventory. An order is an offer to buy; we may accept or reject any order for any lawful reason (e.g., suspected fraud, limited availability, pricing or description error). If we cancel after a charge, we will refund you.

4) Pricing, Taxes & Payment

Prices are shown in U.S. Dollars unless noted. We may change prices at any time before acceptance. You agree to pay all amounts due, plus applicable taxes, duties, shipping, and insurance. We accept the payment methods shown at checkout (availability may vary by device and region). By submitting a payment, you authorize us and our payment processors to charge your card or digital wallet.

5) Custom/Bespoke & Made‑to‑Order Pieces

Custom, engraved, resized, altered, or made‑to‑order pieces (including one‑of‑one creations) are final sale and non‑refundable once design approval or production begins. Estimated timelines are provided at checkout or in writing; they are estimates, not guarantees. Minor variances may occur due to the nature of hand craftsmanship and natural materials.

5.1 Approvals, Deposits & Changes

Design approvals may be requested via sketches, CAD renders, or photos. A deposit may be required to begin work. After approval, change requests may affect price and timeline; additional charges may apply. If a project is cancelled before completion, we may retain deposits and recover our reasonable costs.

5.2 Stones & Materials

We disclose stone type (natural or lab‑grown), weight, color/clarity when known, and metal fineness. Color and appearance may vary under different lighting and displays. Unless expressly stated, we do not provide investment or appraisal advice. You are responsible for independent insurance coverage after delivery.

6) Production Tolerances

Weights, dimensions, and carat totals are approximate and may vary within customary tolerances. Hand‑finished items can exhibit natural, acceptable variations.

7) Shipping, Risk of Loss & Title

We ship to the address you provide. Risk of loss passes to you upon delivery to the carrier (or upon signature at delivery if signature service is used). Title passes upon payment and shipment. We may require signature confirmation and ship with insurance for high‑value orders.

7.1 International Shipments

International customers are responsible for all import duties, taxes, and brokerage fees. We cannot control customs delays.

8) Returns & Exchanges

Our returns policy is incorporated by reference and available at www.articlesofgold.com/returns-and-exchanges. Unless our posted policy states otherwise, the following apply:

Eligible ready‑to‑ship items may be returned within 14 days of delivery in original, unworn condition with all packaging and certificates; shipping and insurance are non‑refundable.
Custom/bespoke, engraved, resized, final‑sale, and made‑to‑order items are not eligible for return or refund.
For exchanges or repairs, contact us at info@articlesofgold.com for an RMA and shipping instructions.

9) Warranty & Care

We warrant that items will be free from manufacturing defects for 12 months from delivery. This warranty excludes normal wear, loss, theft, misuse, accidental damage, stones lost due to impact, and unauthorized alterations. Warranty service may include repair or replacement at our discretion. Please follow the care instructions provided.

10) Repairs, Resizing & Services

We offer paid resizing, polishing, and repair services for AOG pieces when feasible. Service timelines and quotes are estimates. Shipping both ways and insurance are your responsibility unless stated otherwise.

11) Promotions, Credits & Gift Cards

Promotions are subject to their posted terms and may be modified or ended at any time. Unless stated:

Promotional codes, credits, or gift cards cannot be redeemed for cash, are non‑transferable, and one per order.
Minimum purchase, category exclusions, or expiration dates may apply.
$50 Gift Credit (if offered): one per customer/household, applicable to eligible merchandise only, excludes taxes, shipping, gift cards, custom commission deposits; not retroactive; no cash value; void where prohibited; may be revoked for abuse, returns that reduce the qualifying total, or suspected fraud.

12) Private Client / Preferred Member Program

Membership (if offered) is by invitation or application and may grant early access to one‑of‑a‑kind pieces, private previews, or special services. Benefits are subject to change, have no cash value, and may be revoked for misuse or violation of these Terms.

13) User Content (Reviews, Photos, Submissions)

If you submit reviews, photos, or other content (“User Content”), you grant AOG a worldwide, royalty‑free, sub-licensable license to use, reproduce, display, adapt, and distribute such content for marketing and operational purposes, in any media, subject to our Privacy Policy. You represent you own the content or have necessary rights and that it does not infringe third‑party rights or violate any law.

14) Intellectual Property

All content on the Site—including designs, product names, images, logos, copy, graphics, and code—is owned by AOG or our licensors and protected by intellectual property laws. You may not copy, reproduce, modify, distribute, scrape, or create derivative works from our content without prior written consent. Articles of Gold™ and related marks are trademarks of AOG. Unauthorized use is prohibited.

15) Prohibited Uses

You agree not to: (a) violate laws; (b) interfere with Site security; (c) attempt to gain unauthorized access; (d) use bots or scraping tools; (e) misrepresent your identity or payment information; (f) purchase for resale without our written consent; or (g) abuse returns, promotions, or membership benefits.

16) Third‑Party Services

We use third‑party platforms and service providers (e.g., web host, payment processors, shipping carriers). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third‑party acts or omissions.

17) Privacy

Our collection and use of personal information are described in our Privacy Policy at www.articlesofgold.com/privacypolicy, incorporated by reference.

18) Disclaimers

EXCEPT AS EXPRESSLY STATED, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. Some jurisdictions do not allow certain disclaimers; your rights may vary.

19) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AOG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO AOG FOR THE PRODUCT OR SERVICE AT ISSUE IN THE 12 MONTHS PRECEDING THE CLAIM.

20) Indemnification

You agree to defend, indemnify, and hold harmless AOG from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, your misuse of the Services, or your violation of any law or third‑party right.

21) Dispute Resolution; Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict‑of‑laws rules.

Arbitration (U.S. Customers): Except for claims that may be brought in small claims court, any dispute arising from or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis under the Federal Arbitration Act and the rules of American Arbitration Association then in effect. Class actions and jury trials are waived. Judgment on the award may be entered in any court with jurisdiction. You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing info@articlesofgold.com with your name and a clear statement of intent to opt out.

If arbitration is found unenforceable for a claim, the parties consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles, California, USA.

22) Force Majeure

We will not be liable for delays or failures caused by events beyond our reasonable control, including acts of God, labor disputes, supply or shipping disruptions, or utility or telecommunications failures.

23) Termination

We may suspend or terminate access to the Services at any time for any lawful reason, including violation of these Terms. Sections that by their nature should survive termination will survive.

24) Changes to the Terms

We may update these Terms from time to time. The “Effective Date” will reflect the latest version. Continued use of the Services after changes constitutes acceptance of the revised Terms.

Exhibit A — Returns Policy

Return window: 14 days from delivery for eligible, unworn items.
Items must include all original packaging and certificates; any missing items may incur a restocking fee.
Custom/bespoke, engraved, resized, final‑sale, or made‑to‑order items: no returns.
Refunds issued to the original payment method after inspection; shipping/insurance non‑refundable.
For high‑value items, returns must be shipped back via our insured label with adult signature.

Exhibit B — Care & Warranty

Warranty: 12 months for manufacturing defects.
Exclusions: wear and tear, accidental damage, loss/theft, exposure to chemicals, unauthorized repairs.
